The agreement between you and FAMX
1. Definitions and provider
FAMX is offered by Vicky de Groot, based at Kolmeer 39, 8604 EP Sneek, the Netherlands, Chamber of Commerce (KvK) number 81336691 ("FAMX", "we"). "Service" means the famx.nl website and the famx.app application. "Account" means the account you create with FAMX. "Child profile" means a profile within your Account for a child — this is not a standalone user account.
2. Applicability
These terms apply to any use of famx.nl and the FAMX app.
3. Account and minimum age
You can create a standalone Account from age 16. We do not currently offer a standalone Account for users under 16. [TODO: a parental-consent route for younger users is a future legal/technical consideration.] You're responsible for keeping your login details confidential and for activity under your Account.
4. Using FAMX
You use FAMX to capture memories from your own family. Prohibited uses include: posting content you don't have the rights to, using FAMX for unlawful purposes, or bypassing security measures.
5. Your content
All photos, stories, milestones and other content you place in FAMX remain your property. You grant FAMX only the licence necessary to technically store, process and display that content to you within the Service — not to use it for our own promotional purposes without your consent.
6. Subscriptions
FAMX currently offers the following plans:
- FAMX Begin — free. 1 child profile, up to 50 photos, moments, stories, milestones and growth.
- FAMX Verhaal — €3.99/month, or €39.99/year (paid upfront). Up to 5 child profiles, add photos, moments, stories, milestones, growth, your own custom milestones, and 1 extra person to use FAMX together with.
- FAMX Samen — €6.99/month, or €69.99/year (paid upfront). Up to 10 child profiles, add photos, everything in FAMX Verhaal, up to 10 invited people, and per-person permission management.
FAMX Book is shown on FAMX Verhaal and FAMX Samen only as "Coming soon" and is not yet an existing or purchasable feature.
For yearly billing, the full year is charged upfront in one payment.
7. Launch offer
At launch, FAMX Verhaal and FAMX Samen include an introductory offer: the first three months are free. Starting this trial requires registering a payment method via Stripe. After the trial, your chosen paid plan begins automatically unless you cancel before the trial ends. This is clearly communicated before you start the trial. This offer is a launch promotion and not a permanent product feature.
8. Payment via Stripe
Payments are processed via Stripe. If a payment fails, we may ask you to update your payment method; access to paid features may be suspended if payment continues to fail.
9. Price changes
We may adjust prices. For an existing subscription, we'll notify you in advance of any price change, with the option to cancel before the new price takes effect.
10. Upgrading, downgrading and cancelling
You can upgrade or downgrade from your account, or — if that's not available there yet — by contacting us. You can cancel a paid subscription at any time too, from your account or via hallo@famx.nl; after cancellation, the subscription continues until the end of the current billing period and is not renewed.
11. Right of withdrawal
Consumers generally have a statutory right of withdrawal for distance contracts. To the extent you expressly agree to immediate performance of the service when starting a paid subscription or trial, this right of withdrawal may (partially) lapse once the service has been delivered — this is explained clearly when completing sign-up, in line with the applicable legal requirements. 12. Availability and changes
We aim for a reliable service but don't guarantee uninterrupted availability. Maintenance may cause temporary interruptions. We may change or improve FAMX from time to time.
13. Termination
You can request deletion of your Account at any time, via your account or via hallo@famx.nl. We may terminate an Account for serious or repeated breach of these terms.
14. Liability
Our liability is limited to what's permitted by law. Nothing in these terms is intended to exclude liability that cannot be excluded under Dutch law.
15. Force majeure
We're not liable for failures resulting from force majeure.
16. Intellectual property
The FAMX brand name, logo and the design of the Service are owned by FAMX. Nothing in these terms transfers these rights to you.
17. Privacy
How we handle personal data is described in our privacy policy.
18. Governing law and complaints
These terms are governed by Dutch law. If you have a complaint, please contact us first at hallo@famx.nl — we'd rather sort it out together.
